BookingTerminal Terms of Service for Providers

Welcome to BookingTerminal, LLC (“Company”, “we”, “our”, or “us”). These Terms of Service govern your use of the BookingTerminal platform (the “Service”) and any related services provided by us. By accessing or using our Service, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. We may modify these Terms at any time, and your continued use of the Service after any changes constitutes acceptance of the new Terms.

BookingTerminal provides a booking software platform designed for tour operators, activity providers, and rental businesses. The Service includes functionalities such as managing online and in-person reservations, processing payments, and facilitating customer communications regarding their bookings.

4. Payment Processing

All payment transactions are processed through Stripe. By using our Service, you agree to comply with Stripe’s terms of service and privacy policy.

5. Service Fees and Refunds

BookingTerminal charges a 3% booking fee on all online reservations processed through our platform. This fee is separate from any applicable payment processing fees charged by Stripe or other payment gateways. BookingTerminal is not responsible for refunding these fees in the event of customer cancellations, disputes, or changes to reservations. Any refunds related to booking fees or payments must be handled directly by the service provider. BookingTerminal retains the right to modify its fee structure with notice to users.

Your privacy is important to us. BookingTerminal collects and processes personal information solely for providing our Service. We comply with applicable data protection laws, including GDPR where relevant. Payment details are processed by Stripe, and their terms and privacy policy apply to all financial transactions. We do not share personal data with third parties except as necessary for the operation of our Service or as required by law. BookingTerminal is not liable for any lost business or income resulting from system outages or any other issues affecting the Service. In no event shall our liability exceed the amount paid by you to us for the Service in the preceding six months.

All intellectual property rights in the BookingTerminal platform, including but not limited to our code, logo, and all related documentation, remain with BookingTerminal. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purposes.

Either party may terminate this agreement at any time without any requirements or notice period.

You agree to indemnify and hold harmless BookingTerminal, its affiliates, and its respective officers, directors, and employees from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or any violation of these Terms.

12. Force Majeure

BookingTerminal will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, pandemics, or governmental restrictions. In the event of such a force majeure, we will make reasonable efforts to resume services as soon as possible but do not guarantee specific timelines.

These Terms shall be governed by and construed in accordance with the laws of the United States.

14. Dispute Resolution and Arbitration

In the event of any dispute or claim arising out of or related to these Terms or your use of the Service, both parties agree to first attempt to resolve the dispute informally through written communication. If the dispute cannot be resolved within 30 days, it will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. Each party will bear its own costs, and the arbitration will take place in Atlanta, Georgia, unless otherwise agreed upon. This clause does not prevent either party from seeking injunctive relief in a court of competent jurisdiction.

BookingTerminal reserves the right to modify or discontinue any aspect of the Service at any time. We will notify users of significant changes via email or through notifications within the platform. If you do not agree with any changes, your sole remedy is to discontinue use of the Service. Continued use after changes are made constitutes acceptance of the new terms.

16. User Content & Reviews

If you provide content such as reviews or feedback on our platform, you grant BookingTerminal a non-exclusive, royalty-free, worldwide license to use, reproduce, and distribute your content in connection with the operation of our Service. We reserve the right to moderate, edit, or remove any content that violates these Terms or is deemed inappropriate at our sole discretion. You retain ownership of your content but are responsible for ensuring that it does not infringe upon the rights of any third party.
